What is a Decree of Dissolution of Marriage?
Whether you proceed via consent, default or your divorce is contested, your divorce will be finalized with a document called a Decree of Dissolution of Marriage. The Decree of Dissolution of Marriage outlines every aspect of your divorce, including legal-decision making (custody), parenting time and child support for your children, spousal maintenance (alimony), and division of property, assets and debts.
If you proceed via consent, you will submit a Consent Decree of Dissolution of Marriage containing your agreements regarding all of these aspects for the Judge to sign off on.
If you proceed via default, you will submit a Default Decree of Dissolution of Marriage that contains all of your requests regarding these aspects at your default hearing for a Court Commissioner to sign off on.
If your divorce is contested, the Judge will issue a Decree of Dissolution of Marriage with their orders regarding all of these aspects after taking evidence and hearing testimony at a hearing.
